A few highlights from the sessions:

  • Navigating the New Risk Landscape: Presentations by Kenneth S. Abraham & Catherine M. Sharkey and Laura A. Foggan & Michael S. Levine provided a comprehensive overview of the current state of AI insurance. They covered the transition from "silent" AI liability coverage under existing policies like CGL to the emergence of specific, "affirmative" AI insurance products, drawing parallels to the development of cyber insurance.

  • The Rise of "Algorithmic Liability": Renee Henson from the University of Missouri School of Law explored how new forms of "algorithmic harm" are reshaping legal doctrines and creating demand for innovative insurance solutions to fill coverage gaps.

  • Industry in Action: These themes are being actively addressed across the industry. The recent MPL Association Conference, for instance, featured multiple sessions on preparing for AI from a medico-legal perspective, its impact on underwriting, and the risks of new AI-driven healthcare models. Insurers are responding proactively by developing new exclusions, affirmative coverage endorsements, and standalone policies to address risks from data poisoning to algorithmic bias.

It's clear that the path forward requires collaboration between tech innovators, legal experts, and insurers to build a stable and responsive framework for the future of AI.
